TaleLens Terms of Service

1. Welcome & Agreement

Welcome to TaleLens! These Terms of Service (“Terms”) form a legally binding agreement between you and TaleLens (“we,” “our”). These Terms govern your access to and use of our website, applications, and services (collectively, the “Services”).

By using our Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy.

2. Eligibility & Accounts

  • Minimum Age: You must be at least 13 years old (or the minimum digital consent age in your jurisdiction). If you are under 18, you may only use the Services with parental or legal guardian consent and supervision.
  • Account Security: You are responsible for keeping your login credentials secure and for all activities under your account. Notify us immediately if you suspect unauthorized access.
  • Termination: We may suspend or terminate your account if you violate these Terms, pose a security risk, or engage in prohibited conduct. You may request account deletion at any time by contacting support.

3. Intellectual Property & Content

  • Ownership of User Input: You retain full ownership of any text, prompts, images, or other materials you submit (“User Input”).
  • License to Generated Content: Subject to these Terms, you are granted a worldwide, royalty-free, perpetual, non-exclusive license to use, reproduce, display, distribute, and create derivative works from the AI-generated picture books, illustrations, or text (“Generated Content”). You may use such content commercially.
  • No Copyright Guarantee: You acknowledge that in some jurisdictions (e.g., the U.S. Copyright Office and certain EU member states), AI-generated works may not qualify for copyright protection.TaleLens does not guarantee that you can claim copyright over Generated Content.
  • Our Intellectual Property: All intellectual property in TaleLens technology, AI models, websites, branding, and underlying systems remains ours.
  • Feedback: By submitting feedback, you grant us a royalty-free, worldwide license to use it without obligation.

4. Acceptable Use

You agree not to use the Services to:

  • Infringe third-party intellectual property rights.
  • Generate illegal, harmful, hateful, harassing, obscene, discriminatory, misleading, or sexually exploitative content (especially involving minors).
  • Create deceptive deepfakes or synthetic media intended to mislead.
  • Spread malware, spam, or engage in fraudulent activities.
  • Attempt to reverse engineer, scrape, or misuse our systems.

Enforcement：Violations may result in immediate and permanent account suspension or termination, forfeiture of subscription fees, and removal of User Input or Generated Content—at our sole discretion. We may also report unlawful activity to authorities.

5. Payments & Refunds

  • Subscriptions: Access to premium features requires a paid subscription (monthly by default). Subscriptions automatically renew for the same term unless canceled before the renewal date. To avoid future charges, you must cancel through your account before the renewal date.
  • Refunds:
    • You may cancel within 14 calendar days of purchase and request a full refund, provided you have not used the Services (e.g., generated content). If you begin using the Services within this period, you waive your right to a refund.
    • U.S. & Other Regions: Payments are generally non-refundable unless required by law. In cases of extended service outages caused by TaleLens, we may offer prorated refunds or credits at our discretion.
  • How to Request a Refund：Contact support@talelens.com within the eligible period. Refunds are processed within 14 business days.

6. Disclaimers & Limitation of Liability

  • “As Is” Services：The Services are provided “as is” and “as available,” without warranties of availability, accuracy, or fitness for any purpose.
  • Liability Cap：To the maximum extent permitted by law, TaleLens’s total liability shall not exceed the greater of: (i) the fees you paid in the 12 months prior to the claim, or (ii) USD $500. This limitation does not affect non-waivable consumer rights under EU/UK law.
  • Content Responsibility：Generated Content is for entertainment purposes only and should not be relied upon as factual or professional advice. TaleLens is not responsible for the accuracy, completeness, or usefulness of Generated Content.

7. Indemnification

You agree to indemnify and hold TaleLens harmless from any claims, damages, or expenses arising from your use of the Services, your violation of these Terms, or your User Input/Generated Content infringing third-party rights.

8. Dispute Resolution

  • U.S. Users：These Terms are governed by the laws of California. Disputes will be resolved through binding arbitration. You waive the right to participate in class actions. You may opt out of arbitration by providing written notice within 30 days of accepting these Terms.
  • EU/UK Users：You retain the right to bring claims in your country of residence under applicable consumer protection laws.

9. General Terms

  • Changes to Terms：We may update these Terms with notice. Continued use of the Services constitutes acceptance of the updated Terms.
  • Severability：If any provision is unenforceable, the remaining provisions remain in effect.
  • Entire Agreement：These Terms, together with the Privacy Policy, represent the entire agreement between you and TaleLens.
